广州视源电子科技(ji)股份有(you)限公(gong)(gong)司及(ji)各子公(gong)(gong)司（以(yi)下(xia)简(jian)称“CVTE”）严格贯彻(che)出口(kou)管制合规(gui)法律法规(gui)，履行对(dui)合作伙伴的合规(gui)承诺，积极承担公(gong)(gong)司相应的出口(kou)管制合规(gui)义务。
Guangzhou Shiyuan Electronic Technology Company Limited and its affiliates (hereinafter referred to as “CVTE”) strictly abide by laws and regulations on export control compliance, honor the compliance commitments to their business partners, and actively assume their obligations regarding export control compliance.
CVTE产(chan)品适(shi)用(yong)的(de)出(chu)口(kou)(kou)管制法律(lv)法规(gui)(gui)可能(neng)包括(kuo)联合国(guo)(guo)(guo)、中(zhong)国(guo)(guo)(guo)大陆(lu)、中(zhong)国(guo)(guo)(guo)香(xiang)港(gang)地区、欧盟、美(mei)国(guo)(guo)(guo)和(he)其他国(guo)(guo)(guo)家/地区的(de)出(chu)口(kou)(kou)管制法律(lv)法规(gui)(gui)。例(li)(li)如，CVTE在中(zhong)国(guo)(guo)(guo)大陆(lu)制造(zao)产(chan)品，但因制造(zao)的(de)产(chan)品使用(yong)受美(mei)国(guo)(guo)(guo)出(chu)口(kou)(kou)管制和(he)制裁(cai)(cai)规(gui)(gui)定管辖(xia)的(de)器件(jian)(jian)/软件(jian)(jian)/技术，则CVTE遵(zun)守的(de)出(chu)口(kou)(kou)管制法律(lv)法规(gui)(gui)将包括(kuo)美(mei)国(guo)(guo)(guo)商务(wu)部(bu)工业(ye)安全局(ju)（“BIS”）经管的(de)《出(chu)口(kou)(kou)管理条例(li)(li)》（“EAR”）和(he)美(mei)国(guo)(guo)(guo)财政(zheng)部(bu)海外资产(chan)管理办(ban)公室(shi)（“OFAC”）经管的(de)制裁(cai)(cai)性规(gui)(gui)定。
Laws and regulations applicable to CVTE products may include those of the United Nations, the Chinese mainland, Hong Kong SAR of the PRC, the European Union, the United States of America and other countries or regions. For example, although CVTE products are manufactured within Chinese mainland, the device, software and technology governed by the export control and sanction regulations of the United States of America may be adopted for manufacturing such products. Hence, laws and regulations by which CVTE abides may include the Export Administration Regulation (“EAR”) administered by the Bureau of Industry and Security (“BIS”) of the U.S. Department of Commerce and the sanctions regulations administered by the Office of Foreign Assets Control (“OFAC”) of the U.S. Department of Treasury.
CVTE产品(pin)的(de)用途、销售区域(yu)及终端用户由客户自行(xing)(xing)决定，但若双方拟开展(zhan)的(de)业务(wu)被(bei)确(que)认(ren)违反相关出口管制法律(lv)法规，CVTE暂停交货和(he)售后服务(wu)的(de)行(xing)(xing)为不视为违约。
Use, sales area and end user of CVTE products shall subject to customer’s decision. However, if the business to be started by both parties is confirmed in violation of related laws and regulations on export control compliance, the suspension of product delivery and after sales service by CVTE shall not be deemed as a breach of contract.
请采购、获得、使用CVTE产品的客户知悉该等产品的出口、再出口、转让、再转让或传送可能会被美国法律限制，尤其同意遵守：
（1）除已经(jing)取(qu)得必(bi)要的许可外(wai)，承(cheng)诺不会将上述(shu)物料及(ji)使用该物料生产的产品销往受限(xian)制的任何(he)区域(yu)、任何(he)实体或(huo)任何(he)人。
（2）不会自行或通过任何方式(shi)使(shi)第三人将上述物料(liao)用(yong)于(yu)如下用(yong)途(tu)或对象：
（i）核子终端用途；
（ii）火箭(jian)/导弹系统或无人(ren)航空器；
（iii）核子(zi)、生化或(huo)化学武器(qi)或(huo)大规模毁灭性武器(qi)；
（iv）非美国海事核子推(tui)进计划；
（v）非(fei)美(mei)国船舶或(huo)航(hang)空器；
（vi）任何美国外贸管(guan)制法（包括(kuo)15 C。F。R。 Part 744）禁止的军事终端用途；
（vii）任何其他(ta)受(shou)美(mei)国(guo)外贸管制法所禁止的终端用途或终端用户。
Customers that purchase, acquire and use CVTE products should be well aware that to export, re-export, transfer, re-transfer or transmit the said CVTE products may be limited by the laws of the United States of America, and they especially agree:
(1) not to sell the abovementioned materials and products manufactured by the said materials in any limited area or to any limited entity or individual unless otherwise all necessary licenses have been obtained;
(2) not to use or enable a third party by any means to use the abovementioned materials for the following purpose or on the following target:
(i) nuclear terminal;
(ii) rocket/missile system or unmanned aerial vehicle;
(iii) nuclear, biochemical or chemical weapons, or weapons of mass destruction;
(iv) non-U.S. nuclear engine for maritime vehicle application; (v) non-U.S. ships or aircrafts;
(v) non-U.S. ships or aircrafts;
(vi) military terminal prohibited by the foreign trade control act of the U.S. (including 15 C.F.R Part 744);
(vii) end use or end user prohibited by other foreign trade control acts of the U.S.
